TODAY'S RECAP: Yesterday was a slow day on the Iomega message board -- perhaps posters were catching their breath after a few hectic days on the market. A few folks, however, continued the discussion over the mutual patent lawsuits between Iomega and Nomai as well as discussing recent news on Iomega products -- both OEM-inclusion and availability of new offerings (such as the ZipPlus drive and DittoMax).

Interesting find. Some thoughts (remember I'm not a lawyer):

(1) My reading of the opinion is that the Supreme Court overturned the lower court decision which had been in favor of Hilton Davis and returned the case to Federal Court because the original court had not used the appropriate procedure to determine infringement under the doctrine of equivalents. The Supreme Court did not consider the direct question of infringement itself in this case. Am I correct in my interpretation?

(2) The Warner Jenkinson decision does not necessarily imply an easy case for Iomega. As I read the decision, the doctrine of equivalents does not have broad application, in that the court does not want to be in the position of enlarging patents beyond their original scope.

But, there may be an opportunity to use it. It all depends on the specifics of Nomai's disks vis-a-vis the Iomega patents.

(3) Your description of the "paradoxes" is somewhat disingenuous (I don't mean this as a criticism). For Nomai to win in the court of law, they must demonstrate that as regards the specific patented aspects of the disk (typically components of the disk, not how it functions), their disk differs sufficiently from the Iomega Zip disk. In the court of public opinon, Nomai must demonstrate that the disk functions similarly to the Zip disk.

Conversely, Iomega must prove that the Nomai disk is structurally similar to the Zip disk (as regards the patented aspects of the disk) in the courts and that the Nomai disk does not function in the same way/as well as a Zip disk.

(4) Personally, I think Iomega will have an easier time in the legal court than it will in the court of public opinion (if it gets that far).

** Something I have not noticed before.The FujiFilm Zip disk ( $9.99 each ) now have a nice looking disclosure on the casing which shows the Zip Iomega 100 Trademark; is done in bright red and states " for use in Iomega compatible Zip drives " . Is this a new attempt to stop people from purchasing Nomai disk if they ever do become available ? Afterall, according to Iomega, Nomai could not show that emblem ( new label ) on there disk.
