If anyone out there was really holding their breath about this issue, they can exhale now. A judge has thrown out a second lawsuit brought against McDonald's (NYSE:MCD) by a group blaming the fast-food king for obesity and health problems.

U.S. District Court Judge Robert Sweet disagreed with the plaintiff's claims that Mickey D's employed deceptive advertising designed to cover up the fact that its food is, well, full of fat and other icky stuff. McDonald's said the ruling is "a total victory for common sense." Furthermore, Judge Sweet said the suit could not be filed again.

A spokesman for the plaintiffs said his group would try again on different grounds, this time claiming that the old "french fries up the nose trick" can lead to acne of the nostrils. (OK, we're kidding about that.)

In an unrelated but totally ironic story, McDonald's is teaming up with the city of Houston to help "slim down" the town, which was named the fattest in the nation for the third straight year by Men's Fitness magazine. The restaurant will help the "Get Lean Houston!" campaign by offering several menu items with less than 10 grams of fat.

Rest assured, the Big Mac and Quarter Pounder are not among them.
