Chemical maker DuPont on Thursday said it won an appeal in patent-infringement case against MacDermid Printing Solutions LLC.
The case relates to patents Wilmington, Del.-based Dupont has on its Cyrel FAST thermal flexographic technology, which is used to print color images on packaging materials such as paper foil and plastic film.
DuPont sued MacDermid in 2006 over the patents.
The U.S. Court of Appeals for the Federal Circuit ruled that a lower court erred when it questioned the validity of DuPont's patent due to confusion over the patent's proper filing date, according to DuPont.
The Court of Appeals also upheld the lower court's decision that MacDermid did not dispute infringement of DuPont's patent and said the lower court correctly ruled there was reasonable likelihood that MacDermid infringed one of DuPont's patents, DuPont said.
DuPont said it will renew its motion for preliminary injunction seeking to stop sales of MacDermid's LAVA thermally developed flexographic printing plates, including MLT and Magma products.
MacDermid said it does not comment on ongoing litigation.
