West Virginia's attempts to discipline Massey Energy Co. and eight mine workers over a January 2006 fire which killed two of the coal giant's miners have been delayed again.
Because the Aracoma Alma Mine No. 1 fire is still the focus of an active criminal probe, the state Coal Mine Safety Board of Appeals decided Wednesday to wait while the U.S. Attorney's Office investigates. The panel has delayed action several times before and now plans to revisit the cases in September.
West Virginia wants to suspend or withdraw mining certificates held by six Aracoma workers and fine two others. Another worker already agreed to a suspension.
Richmond, Va.-based Massey, meanwhile, is appealing $70,000 in state fines. Massey also is contesting a record $1.5 million federal fine related to the fire.
