12 Shocking Truths About Obamacare

There's more in Obamacare than you might think. I recently embarked upon an arduous task to find out what those things might be by reading the Patient Protection and Affordable Care Act -- all 906 pages of it. I'll admit that my eyes did tend to glaze over quite a bit, but I slogged through it. And while there was plenty of language describing provisions we have all heard about, like the individual mandate, I discovered several items in the law that were a bit strange and surprising. Here are 12 shocking provisions hidden in Obamacare.

1. Music to the Fool's ears
The Motley Fool has long promoted the importance of teaching youth about financial matters. Section 2953 of Obamacare is like music to the Fool's ears. The section specifically calls for educating adolescents about financial literacy to prepare them for adulthood. That's the good news. What's the bad news? The government teaching anyone about financial matters is like Lindsay Lohan teaching personal responsibility. 

2. Size matters
Next time you get your explanation of benefits from UnitedHealth (NYSE: UNH  ) , check out the font size. It better be at least size 12 font, or the company is violating the law. Yes -- Obamacare mandates that insurance companies use that font size or greater. This specification is part of a section intended to ensure that customers can read and understand the documents sent by insurance companies. Maybe cartoon drawings could help, too.

3. A nod to Charlton Heston
Late actor and National Rifle Association president Charlton Heston famously said that he would only give up his gun when it was pried from his cold, dead hands. Mr. Heston would probably have liked at least one part of Obamacare. Language in the act specifically prohibits companies operating health and wellness programs from collecting information about gun ownership or usage.Obamacare protecting gun rights. Now that's shocking.

4. Patrolling deep health care waters
Who would you expect to be included in Obamacare's Interagency Working Group on Health Care Quality? If you said the Food and Drug Administration or the National Institutes of Health, you'd be correct. However, you would also be right if you mentioned the Coast Guard. Yep, listed among the agencies responsible for determining how to improve health care quality is the guardian of our nation's waters. With stress contributing so much to health care problems, I'd think that one of the biggest causes of stress for Americans -- the IRS -- might be a better agency to include. 

5. What's good for the goose
If you have ever complained about Congress passing laws that don't apply to themselves, you might be surprised to find out that our senators and representatives must enroll in an Obamacare plan like everyone else. Well, nearly everyone else. The White House wasn't mentioned in the section requiring Congress to use approved health plans. However, an administration spokesperson indicated that President Obama will voluntarily participate in a health insurance exchange established by his signature legislation.

6. It's fine if the dog eats their homework
Nearly three pages of Obamacare provide excruciating detail about reports that the Independent Payment Advisory Board, or IPAB, should submit to Congress. What if they don't do their homework? No problem. If IPAB doesn't do what it is required to do, Obamacare says that the Secretary of Health and Human Services must create the report instead. Government accountability at work, folks.

7. Add IPAB to your Christmas list
Speaking of IPAB, Obamacare specifically states that this board charged with determining how to control health care payment costs can take gifts. No limitations are given. In case you can't think of a good gift, the legislation mentions that services or property are fine to donate also. IPAB can by law sell anything you give them, though, so be forewarned.

8. Sense and nonsense
Language is included in section 9023 that "the sense of the Senate" is that nothing should be done related to the legislation that would increase taxes on the middle class. I suggest reading Dan Caplinger's excellent summary of new Obamacare taxes impacting all Americans before deciding if the "sense of the Senate" is better described as nonsense.

9. Funny money
In case you didn't think Congress was funny, they stuck a provision into Obamacare that specifies that humor can be used in a marketing campaign about preventive care. How much was allocated to be spent? Only $500 million. My guess is that someone's laughing all the way to the bank.

10. Protecting the 1%
Drugmakers got slapped with billions of dollars in new taxes and fees -- but not for the most expensive drugs of all. Orphan drugs are excluded from new fees. This means that companies like Alexion Pharmaceuticals (NASDAQ: ALXN  ) won't have to pay the extra fees on sales of $440,000-per-year Soliris. Obamacare protects the 1% -- of high-cost drugs, at least.

11. The greatest tax of all
While there are plenty of new taxes in Obamacare, it might be surprising what gets taxed the highest. If you have a really great health plan, you get hit with a 40% excise tax. Too much health care must be a bad thing.

12. Ironic
Last, but not least, Obamacare prohibits false statements or representations about any Obamacare-approved plan. The provision itself isn't surprising, but the irony is. Section 1501 states unequivocally that Obamacare "will lower health insurance premiums." Aetna (NYSE: AET  ) CEO Mark Bertolini, though, said recently that premiums will rise as a result of the legislation, with some premiums doubling. Even Health and Human Services Secretary Kathleen Sebelius admitted not long ago that some premiums would rise with Obamacare. Ironic indeed.

    Very good article. This information needs to become more mainstream and I believe it will be once the Unaffordable Healthcare Act starts kicking in to mandatory coverage for everyone. The whole thing is a logistical mess and nobody really knows how to implement it. It's a Dr. Strangelove scenario and one needs to have more of a sense of humor about it. I'm the eternal optimist that most if not all of this thing gets struck down once the public freaks and gets more confused. Remember the general American public has a very short attention span and to ask them to mandatorily fill out endless forms and provide personal information? Yeah that's gonna happen right?

    Very good article and congratulations for the full read. We need this. In all states. I will pay a little more to get the uninsured insured. Now the attitude is "if you cannot afford it, tough". How many deaths has this caused? This is so wrong. I am so glad to see the legislators will have the same coverage as I will have. We will have in house watchdogs. I suspect those who are really against it have free or low cost employer contributed insurance or government insurance which does not discriminate as to age and physical condition. Good for them. But, that is surely going to change anyhow, with some employers already requiring people to give up private information and go on exercise and work out plans. We need a level playing field. Bring it on. We can tweak it later if need. Better than nothing.

    Please learn the facts before you blame everything on Obama ..its not like Obama wrote the whole bill or that he approved each line in it .. I am not a Obama supporter, but we all know how politics work and how much this law was debated and how things get added to laws when it is about to pass .. so better not comment on things we do not know of...

    The truth is, and as most states are now figuring out, ObamaCare is all about cutting cost and improving health outcomes of individuals.

    Under ObamaCare, Stage Two, Meaningful Use requirements hospitals will be financially penalized for readmissions in first 30 days of discharge. Why? because the research clearly shows that the hospital just didn't take care of their patients through followup after discharge. It's one expense that is simple to cure.

    We have a name for it in our Free Market World, which the "Motley Fool" knows very well, is called "Pay for Performance." Which is exactly the same way the Motley Fool gets paid!!! Perform, or know one pays for their service.

    Also, please be aware that for every dollar you spend on insurance premiums the insurance company takes 30 cents out of every dollar received from you to hold up shareholder value. That means your insurance company and their shareholders get their "financial shot in the arm" before you or your health provider gets there's.

    Now, if you believe that your health should be for insurance and shareholder profit then go ahead and keep paying the sky rocketing premiums. (In the last 18 months we have paid for two premium increases for my wife totaling 29% and that is with a $2,500 deductible. And she is perfectly healthy).

    On the other hand, if you don't believe your health should be for insurance and and share holder profits, then ObamaCare is a whole lot cheaper, it's a better economic solution and your chances of staying alive and healthier is measurably better than the "Fool" would have you believe.

    At the core of ObamaCare, as I said, is pay for performance metrics, which will bring down cost, shrink the amount the US pays in GDP and make any free market capitalist feel really healthy.

    I would not trade my country for any other country in the world, but I would trade the 18% of GDP that our country spends on healthcare for the 3% Europe spends and achieves much better health outcomes for each of their citizens.

    That's a 15% gain, which the "Fool" should love! That same 15% savings translates into trillions of $$$$ that could be better invested into education to keep us globally competitive, create a better prepared military, expand tax credits to entrepreneurs that in turn will expand our production and idea output, increase exports and add millions of new jobs. And that means we'll all enjoy a healthier nation.

    ObamaCare is good economic medicine and is based on what free market analyst and investors love the most... The NUMBERS!

    I am sorry but I have also spoken with United Healthcare and I find it very difficult to believe that you got any useful information from them. In Nov I got a flu shot at a local Walgreens since then I have gotten 4 explanations of benefits, 3 of them advising me to get a flu shot free at Walgreens. The statements have said that I owe Walgreens values between 18.95 and 38.95 (note that Walgreens charges $20 without insurance). Calls obviously haven't helped as those that answer the phone are as clueless as the day is long.

    I been working as an partime faculty at a community college, been there for almost 6 years. Ive been getting 13hrs per week (basically 2 classes). Thanks to obama care, dean of the college called me in and said starting 2013 fall, I will only be allowed to take 1 class, otherwise they need to pay me benefits. So basically, my paycheck is cut in half. I thought, atleast this obama bill would mandate employers not to fire/ cut hours for employees they already hired; I work in govt sector (community college) so atleast I hoped he wouldve made this as a manadate in the govt sector.

    So my fulltime colleague said, by cutting my job in half, its helping to create a job for another, so instead of 40 adjunct faculties, 80 adjunct faculties, good gimmick by obama, yes he did boost our job market by robbing the middle class.

    When they introduce such a bill, do we have morons in washington, who cannot think through what employers might do to protect thmeselves? or they are doing this on purpose? Anyway, let GOD be the judge.

    6th - The CBO has now states that ObamaCare will increase costs by 2.8$Trillion.

    7th - The IPAB panel established in ObamaCare is a Rationing Board (Death Panel). They will decide what things are covered these so called Recommendations can only be overridden by a 2/3 Majority of both Houses of Congress. This will never happen - in the last 100 years only Democrats have had Filibuster proof Majorities in both Houses and even then they did not have 67 of the 100 Senators that would make a 2/3 majority.

    8th - ObamaCare mandates that Insurance Premiums for older people can not be more then 3 times that of younger people. What this will do is dramatically increase the cost of Insurance for younger people. (this will kill opportunities for our kids and grandkids to advance to higher Income levels) or cause them to drop insurance and just pay the Penalty. Most of these younger people are healthy and don’t even need Health Insurance and many don’t buy it now because of the expense – but now they will have to buy it at even higher rates or pay a penalty- does that make any sense??

    9th - The CBO now states that between 32 and 40 million citizens will not be insured after ObamaCare becomes effective (2014). Supposedly the big reason for ObamaCare was to make sure everybody was insured including the 30 million uninsured – ObamaCare doesn’t even accomplish that!

    Look at some of the early results of the ObamaCare Mandates

    1) Restaurants and colleges are decreasing the hours of their workers and professors to under 30 so they won't have to pay for their insurance - which means the government will have to subsidize more people - more cost - means we have to pay higher taxes, premiums etc.

    2) Small companies trying to stay below 50 employers - same thing.

    3) Many companies are now making changes to their plans so that they will drop spouses and children and Only insure the employee.

    4)The IRS Says in 2016 the least expensive Insurance Policy for a family of 4 will be $20,000. Yea Obama!!

    I predict that within the next 10 -15 years ObamaCare will be replaced with a Single one-payer plan - basically the entire Health Insurance Industry will be Nationalized, America will no longer be inventing new life saving devices and drugs, and we will have a 10 -20% VAT Tax to pay for this.

    The American people have been sold a phony bill of goods and we have been jetted into becoming a European type Socialist nation.

    I can't agree with many of you profiting off other illness or misery is disgraceful.

    My son had a surgey delayed by a Insuance Company by 4 days and when it became "Medically Neccessary" the time has passed when he would not have brain damage.

    But hey it was the end on a Quarter for the Insurance Company and they had to show a big profit for all the Mutal Funds invested with them.

    So what if my son no longer talks and walks with a limp and is almost potty trained now at 16 years old.

    That delay they caused has handed the U.S. Taxpayers a huge bill for his care when I am gone. So they saved $24,000 just for that 4 days.

    Then 4 days later the Medflight to the Hospital and Emergency Surgey only cost a little over $190,000 so yeah Good Job Brownie saving the Insurance Company money. Maybe they hoped he would have died.

Just like the current amnesty, previous amnesties failed and have only contributed to this current enormous problem and burden cast upon us, yet you do nothing?

    If you would only take as much time as you spend writing on computer sites and address your elected official with your opposition to these atrocities, then maybe we wouldn’t be here discussing and complaining about the negative effects!!!!!!!!!!!

    Do you really believe the core of ObamaCare, is pay for performance metrics, which will bring down cost, shrink the amount the US pays in GDP? Take a second look! The IRS reports that in 2016 the least expensive Insurance Policy for a family of 4 will be $20,000.

    I would not trade my country for any other country in the world. Do we Americans want to end up like Europeans who spend and receive such sad health outcomes for each of their citizens, the seriously ill come to America for treatment instead of waiting to die in hopes of even getting an appointment and treatment at home.

I like to see a sensible, affordable health care program for all. Even under German Socialized Health care are different premiums and choices according to income. Our government seems to embrace the communistic motto " all for one...." and forgotten that this never worked
