On Friday, Brocade Communications (BRCD) announced that a federal judge in San Jose has confirmed a $60-million jury award in its favor, delivered on August 6, 2012, along with issuing a permanent injunction barring the defendant, A10 Networks, from infringing on Brocade's "Global Server Load Balancing and High Availability" patents.
In a statement, Brocade noted that A10 is now forbidden from "making, using, selling, or offering to sell in the United States, or importing into the United States any AX series application delivery controller that includes features that infringe" on its patents.
The judge in this case confirmed $60 million in damages awarded to Brocade for A10's copyright infringement, and also noted that a further $50 million in damages for lost profits under the patent claims may be due Brocade. The court has ordered a new trial to determine the extent of the patent damages, and to decide solely on an appropriate award for the patent infringement and for any punitive damages.
Brocade shares are up 2.4% on the news at $5.60.
